1. Acceptance of Terms
By accessing the PowerPlay website, booking through our online platform or Facebook Messenger, or entering the PowerPlay facility at Ridgewood Commercial Space, P. Sanchez, Pagsabungan, Mandaue City, Cebu, you agree to be fully bound by these Terms of Service and all applicable Philippine laws, including Republic Act No. 7394 (Consumer Act of the Philippines) and Republic Act No. 8792 (Electronic Commerce Act). If you do not agree, do not use our services.
2. Services Offered
PowerPlay provides rental of indoor racquet sports courts (pickleball and badminton) on a pay-per-use basis. The facility operates 24 hours a day, 7 days a week. Reservations may be made through the following channels:
- Online booking platform (website)
- Facebook Messenger via the official PowerPlay Facebook Page
- Walk-in — permitted, but customers must call or message PowerPlay first to confirm court availability before arriving. Walk-ins without prior confirmation are not guaranteed a court.
3. Booking & Confirmation
A reservation is considered confirmed only upon receipt of a booking confirmation (reference code via email or written confirmation via Messenger) AND receipt of full payment. Unconfirmed bookings without payment do not constitute a guaranteed reservation.
PowerPlay reserves the right to cancel or reschedule a booking due to facility maintenance, safety concerns, force majeure events (e.g., typhoons, natural disasters, government-mandated closures), or technical errors. In such cases, a full refund or rescheduling option will be offered to the affected customer.
4. Payment
Full payment of the total court rental amount is required at the time of booking to confirm a reservation. This applies to all booking channels — online, Facebook Messenger, and walk-in.
Payment is made via GCash. Customers are required to send a screenshot or photo of their GCash payment confirmation to PowerPlay via Facebook Messenger or the contact channel provided at booking. The booking is not considered confirmed until full payment and proof of payment have been received and acknowledged by PowerPlay staff.
PowerPlay reserves the right to revise pricing at any time. Any price changes shall not affect reservations that have already been confirmed and paid.
5. Cancellation & Refund
Customers may cancel a confirmed booking and receive a full refund provided the cancellation request is submitted at least forty-eight (48) hours before the scheduled session start time. Refunds are processed via GCash within 3–5 business days.
Cancellations made less than 48 hours before the session, or no-shows, are non-refundable. Full details are set out in the PowerPlay Refund Policy and Cancellation & Rescheduling Policy.
6. Reservation Transfer
Confirmed bookings are non-transferable without prior approval from PowerPlay. A customer may not give, sell, or reassign their reserved slot to another person without first obtaining written approval from PowerPlay staff.
7. Late Arrival
Late arrivals do not extend the reserved playing time. The booking shall end at the originally scheduled time regardless of the player's actual arrival time. This ensures fairness to the next reservation in the schedule.
8. Player Conduct
All persons using the facility must behave respectfully toward staff, co-players, and the facility at all times. PowerPlay reserves the right to remove any person from the premises for disruptive, unsafe, threatening, or inappropriate behavior without any refund.
Players are responsible for the conduct of their guests. Any damage caused to facility equipment or property through negligence or misconduct will be charged to the booking party.
9. Assumption of Risk & Liability Waiver
Pickleball and badminton are physical sports that carry inherent risks of bodily injury. By using the PowerPlay facility, you voluntarily assume all such risks.
PowerPlay, its owners, operators, staff, and affiliates shall not be held liable for any personal injury, death, loss of or damage to personal property arising from the use of the facility, unless caused by gross negligence or willful misconduct on the part of PowerPlay personnel.
Customers with pre-existing medical conditions are advised to consult a physician before engaging in court sports at the facility.
10. Minors
Players under 18 years of age must be accompanied by a parent or legal guardian who shall be responsible for the minor's conduct and safety within the facility. The accompanying adult assumes full liability for the minor during the session.
11. Data Privacy
Personal information shall be collected and processed in accordance with the Philippine Data Privacy Act of 2012 (RA 10173). As online booking requires customers to provide personal details, full details on how this data is handled are set out in the PowerPlay Privacy Policy.
12. Intellectual Property
All content on the PowerPlay website and social media pages, including the logo, brand name, photographs, and text, is the exclusive property of PowerPlay. Unauthorized reproduction, distribution, or commercial use is prohibited under Philippine intellectual property laws.
13. Governing Law
These Terms of Service shall be governed by the laws of the Republic of the Philippines. Any dispute arising shall be subject to the exclusive jurisdiction of the appropriate courts in Mandaue City or Cebu City.
14. Amendments
PowerPlay reserves the right to update these Terms at any time. The revised version will be posted on the website and/or official Facebook Page with an updated date. Continued use of services after modifications constitutes acceptance of the revised terms.
